The PAJA has become the legislative foundation of the general administrative law of South Africa. Though analysis of an administrative-law issue will not end with the Act, it certainly must begin with it, give attention to and interpret the Act’s provisions.
This book is a second edition of the work first published as the AJA Benchbook (2002). It aims at providing the Act’s interpreters with guidance on this process of interpretation, rather than covering South African administrative law comprehensively.
The second edition provides a comprehensive commentary on the PAJA and Regulations, including reference to all significant case law since 2001. The text of the Promotion of Administrative JusticeAct 3 of 2000 (as amended) and the Fair Procedure Regulations are included as appendices.
