Increased risk, uncertainty, and palpable discrepancies in regulation and practice inundate the twenty-first century commercial law sector. As a result, the expectations that society has of business are seriously threatened by the technology and globalisation associated complexities. Further, technological advancement and globalisation related challenges make it more difficult for the business sector to efficiently take the lead in realising the Sustainable Development Goals of the United Nations, and the African Union’s Agenda 2063.
Commercial law must be viewed as serving the welfare of society as a whole, not just corporate interest, in a time when governments in Africa, especially Southern Africa, are looking to empower societies and include them in the economic mainstream, increasing the distribution of wealth and raising the standard of living for the majority. To meet the expectations of the market and society, legal professionals, students, and educators must address the extant complex commercial law issues. In the post-industrial, neo-liberal, and neo-classical periods, commercial law has been largely influenced by technological advancements, digitalisation, and the modernisation of company procedures. These technology advancements have changed how corporate governance and financial market regulation are approached, among other related issues. Law teachers and legal professionals must therefore address the benefits and challenges brought about by advancements in artificial intelligence, modern digital technology, and the associated regulatory concerns.
To prevent possible threats to the discipline and associated disciplines, law teachers must do their part in addressing the intricate problems in commercial law. Law teachers must thus explore the prospects and challenges presented by contemporary technology advancements. It is in this regard that authors of chapters of this edited book project establish a foundation for conceptualising the function of legal scholars and practitioners in tackling the intricate commercial law problems that businesses and society at large encounter in the twenty-first century. The authors of the chapters sought to achieve a balance between twenty-first century technology advancements and prudent commercial law regulation. This was done in order to identify the prospects and challenges for social development and regulatory advancement posed by globalisation and technological advancements.
