This sixth edition of Dugard’s International Law: A South African Perspective builds on the legacy of John Dugard’s iconic book on international law in South Africa. At the same time, the substance of the work has undergone major changes to take account of new developments both on the international legal scene and in South Africa since the last edition. These include major decisions of the Supreme Court of Appeal and Constitutional Court of South Africa, and of the International Court of Justice. Some chapters from the fifth edition have been merged for better organisation and focused treatment of their subject-matter.
The sixth edition appears at a time of tumult in the international legal order, and important debates about the relevance, rules and resilience of international law. Despite this, international law remains an indispensable framework and glue for holding nations and humankind together. Awareness of this truth is a thread that runs through the sixth edition.
Dugard’s International Law: A South African Perspective describes and examines the basic principles of international law with reference to the principal sources of international law. This examination takes place within the context of South African law. South African state practice, judicial decisions and legislation on international law receive equal treatment with international law as it is practised and taught abroad. The present work is designed to assist judicial officers and practitioners, educate students, and guide diplomats in the intricacies of international law both at home in South Africa and abroad.
Like its predecessor, the sixth edition is the work of a team of authors: Max du Plessis, Tiyanjana Maluwa and Dire Tladi have joined John Dugard as editors and authors of particular chapters. In addition, other chapters have been authored or co-authored by Eshed Cohen, Andreas Coutsoudis, Jackie Dugard, Rosalind Elphick, Anton Katz, Kholofelo Kugler and Arnold Pronto.
